I have several friends who were waiting for GC desparately and they thought it was the final destination. They had many reasons why to get GC and once they get, they will be free and can do / will do everything possible. But, once they got it, they settled in a permanent job. Without GC, they were working for the same client with even more pay and life was good if not better.
I was thinking the same way; because I am no different.
Oflate, I realised, I am un-necessarily worried about something which is not in my control. I realised that I am well paid, with this pay even the benefits I am not getting are compensated. Why am I worried? Should I be after GC in order to get peace of mind? I started looking it little differently. I am in this country to earn more money and live comfortably. I am already enjoying what I wanted. Then, why am I worried still? May be it is in human nature to always look for something which is not in the hands.
I still need GC for other things like Children education and get some other benefits (our education / starting business etc). I agree, but there is lot of time for that in my case. There are several people who are in the same state as me if not all. Everyone's needs are different.

Has anybody heard the story of the canadian skater who was allowed to become a citizen in an expedited manner (she had one more year to go before meeting the 5 year criterion for eligibility after GC) just before the olympics. Actually, I think she won a silver medal at the olympics for the USA.
Anyway, from what I hear, she had gotten her GC in 2002 and had been living and training in Detroit with her american skating partner. When she decided to participate as an american, but was not elibible to apply for citizenship until 2007. So, she contacted a lobbyist to help her with her case. The lobbyist was able to convince a michigan senator (not sure who this is) to help. The story is that the senator was able to include a measure in the bill signed by the President in Dec to make it legal for people in the situation such as the skater to apply for citizenship even when the 5 year period is not complete. The measure got passed when the president signed the dec bills.
So, they filled her application, got the immigration services folks in Detroit to come out during the chrstmas holidays specifically for her, and got her the citizenship in time for her to get her passport for the games.
So, my point is...if it is legal for the lobbyist to help her (a non-citizen) with her immigration case and it was legal for the senator to introduce the measure, why would it be deemed illegal to do what we are attemting with our lobby firm and our efforts to meet and talk to the senators and congress people?

I don't know if my NC is cleared. Tried to find it couple of times calling over phone but always ran into unfriendly IO officers.
Got out of BEC in dec 2006, I140 cleared in Jan 2007 but then my PD became current only in June 2007. And due to laziness of my law firm, my I-485 filing did not happen in June and got dragged into July 07 mess.
I think if USCIS had initiated my Namecheck as per normal timeline (sometime around when my I-485 filed , i.e anywhere between July - Sep 2007), then yes, I think it crossed 180 days long time back.

I am planning to utilize AC21. My PD is OCT 2005, EB2 India, I-140 was approved in June 2006 and I-485 filed on 2nd July 2007.
The question I have is if my current employer can do anything, I mean anything at all, now?

LS is not illegal until the employers sell the labor. LS is legal channel where in employer fill the position with somebody else, if primary applicant it not available for some reason.
But some employers are exploiting the law and selling it. This is ILLEGAL. I agree with that LS is LEGAL until it goes in a legal way. But selling or getting other benefits/gifts from the employee is completely ILLEGAL.
Since USCIS cannot find who is selling and who is not selling, they banned it. It is a good move from USCIS, but it is too late. Too many got like this and enjoying the benefits leaving other poor souls who are waiting in line from years.
I had a friend who came here after me, say I think in 2001, he got laid off and had gaps in his employment, he married this girl who joined a company head quartered in IOWA, the payroll stubs used to be in excel sheets. He was probably in the point where if we went to India, they would not have let him come back on H1. They paid 10K to get LS (adjusted through employment for 1 year) and when I-140 and 485 were being allowed for consecutive filing I believe Dec2004, filed it. He called me a month back saying they got their physical card. His PD date somewhere 2004 EB3. My PD March 21 2003, am I frustrated of course, but I am frustrated with the system that has loop holes, as pointed out there are hundred of people who have legitimately used LS.. there is no point losing sleep over it.
The need of the hour is this, to be together and fight together, not among each other. IV does not differentiate between LS and non LS, or degrees or anyone's individual cases or scenarios. IV's goal is very simple, GC process should not take more that 2 years and anything that reduces the total time frame, that is what IV stands for. Time is key, lost time cannot be regained, what is in for is now and the future, lets stick together and think about how we can help IV meet this goal, that none of us should be waiting many many more years to come. Can we all agree on this and go forward please?

There should a seperate quota for immigrants from Jhumri Talliya
In the same lines as H1B, could we look into if its possible to add a quota for US Masters degree holders irrespective of country of birth for green Card also. This would be in addition to the existing Employment based quotas.
Does anyone know how they added 20k H1B quota for Masters degree holders? Who sponsored that bill? May be we should talk to the same people.
I would think there would be a little less resistance for this? This would ease the pressure on both EB2 and EB3.
I dont know if this has been previously looked at. I know there were talks of excluding these people from quota all together.

So if you ask me today, would I rather have filed 485 with a PD of 2006/7 or be in your situation, as bleak as your situation looks today, the better choice might be your situation.

Again, once he/she files 485, his 485 is not going to be processed immediately. AP, EAD may be issued but it may take 6-9 months for 485 to get processed.
However, if PD moves so much ahead that your PD is also current, then you will get your GC (if other processes are complete) whereas he/she would have just filed 485.

Attorney fees also increase in proportion to the USCIS Fees increase.
If you have noticed, the Attorney fees are relative to the form that they are working on. Historicaly, attorney's have increased the fees everytime there is an USCIS Increase.

My PD was current back in 2004, this attorney/employer ignored my calls/emails from Oct to Dec 15. They filed my 485 during christmas week end, they screwed up something and USCIS rejected my application (thats what they say). Thanks to retrogession from Jan 2005. All my documents were ready by Oct. I would have had my EAD since 2005.
De javu, again I am being mandated to file thru same attorney. I don't have problem paying more money for a good attorney and good service.
I don't know if I am in a trap or something.

This is a very good, logical, sensible analysis.
I live in the US but I have been to canada a number of times on extended business visits, and my impression was that quality of life is very good over there. Granted, you dont earn as much money (or possess as much in material wealth, as someone put it) as in the US .. but that is compensated for by much safer neighborhoods, good social security and far more immigrant-friendly policies. The immigrants are much more integrated into society there than the US. I realize this may not be true for all regions for canada, but at least in BC and Ontario its very true. So it depends what you are after .. opportunity and earning potential are both better in the US .. but overall quality of life is as good or better over there. The quick turnaround time for permanent residency makes it very attractive for young people like me who havent already invested in settling down in the US .. I would rather live with "limited" opportunity there than remain in the US and be at the mercy of a single employer for 10 years.

They say that they will run Master's cap first, then put the leftovers into regular cap lottery pool. But it would be better for master's degree holders if they did it the other way around!
We know the master's odds are better than general pool odds. Maybe about 50% vs. 25% this year.
Think through the math! It would be more advantageous for Master's degree holders to go through the general lottery first, and only if they lose in general be put into master's lottery. Maybe there would be less than 20,000 general lottery losers with advanced degree, then there would be no need for another lottery, they would automatically get the 20,000 that's allocated for them.
Is USCIS trying to screw Master's holders on purpose, or are they just bad at math and screwed them due to ignorance?
The spirit of the whole master's cap law is to give master's holders an advantage. USCIS had a choice here of giving a small advantage (master's lottery first, then general) or big advantage (general lottery first, then master's) and they chose the smaller advantage.
The whole fact that we're here thinking about the odds, just like horsebetting, is of course ludicrous in itself.

There are rumors that we will be around 5000 at the rally. Let's prove them wrong and bring at least 10,000 of our members. I am willing to share more funds for people who so far are not planning to attend, and to advertise and promote the rally as much as possible. Guys, we still have nearly 3 weeks, we can get to 10,000 and beyond! Let's work hard now to accomplish that! Please post your ideas here to make it more than 10,000. Just like telethons have a target donationn amount to be raised, we should have a minimum attendance target for the rally to achieve! Personally I do think if DREAM ACT is passed, it will be easier to voice another bill to be passed to allow legal working immigrants (EB-1, 2, 3) to get green cards. I said this based on logical reason----people from DREAM ACT are illegal immigrants, so if DREAM ACT is passed, illegals will be turned into legal immigrants. So by logical reasons, legal working immigrants gain legal entry to US for jobs or for schools before, they should get green cards by logical and reasoning approach because they have paid taxes and expensive international tuition fees for years to help the US economy before.
Also, since NOT all EB legal working immigrants have US advanced degrees in Science & Medicine, therefore, similarly by logical and reasoning approach, any US advanced degrees in Science & Medicine graduates should have a chance or path to get green cards or to start up companies in US to help the US economy better. More legal immigrants buy houses and set up companies in US, more jobs created and more prosperous the US economy will be
