Found some interesting information at this URL (http://www.ilw.com/articles/2006,0321-murthy.shtm)
"While a denial due to USCIS error can normally be addressed in a Motion to Reopen, it is obviously never a good situation, especially if the applicant and/or the family members do not have a backup nonimmigrant status, such as H1B or H-4. Without the backup status, each I-485 applicant will be immediately out of status upon issuance of the denial. Often all employment cards are no longer valid once the I-485 is denied, as well, causing an additional financial toll on a family."
This looks from murthy and contradicts with what Ron Gotcher mentioned on his website.

common.. How they can track? though I did sent flowers.. :)
Well i am writing to everyone for my case. I don't know it will help. But nothing harm in trying...
I did sign G-38 (whatever that number is) for attorney. Can I still send email from my end to USCIS, congressmen and all the team requesting explanation on my application?

NO Matter how many people say "Take it easy" its simply not possible, you will have to be a superhuman to do that. Sure its stressfull but no more stressful than boarding your first flight to USA. no more stressful than attending 1st H1B interview at the consulate or your first client interview. So in the end, we have been through all the hurdles with most of us surviving 2001-2002 job markets and now is 2007.
The point is we have been through all that successfully and thats a BIG WIN. So we will be through this too, but not without stress. The day we decided to come to USA and until now we have been successful as we are resourceful and can improvise at a short notice and we will. We are shrewd individuals and We Will PREVAIL.
Amen....

Did any one get their GCs WITHOUT getting the CPO email? I got PDA emails Sep 11 (saying that they have approved the I485 applications), followed by SLUDs Sep 13. I didn't get any CPO email or other notification. Should I expect the CPO emails and THEN the GCs, or just simply the GCs?
As I read through forums, I understand that there is no consistency in those sequence of online updates.
You may receive your cards without getting the CPO.
There is a chance that, your fingerprints might not be refreshed so you may be requested for FP - if such a thing happens, you will be notified.
I am under the impression that it is just a system glitch.

I am also July 2nd filer with no checks being cashed yet, and no other activities around my case. What can we do when the waiting period is over 90 days???
I believe, USCIS has a formal method of investigation. You or your lawyer will have to give details whatever USCIS asks for. In a normal course, this would have been done a lot sooner, but USCIS themselves admit that they are not yet finished with all July2-Aug17 receipts. Perhaps they will not entertain any formal investigations until they are done with all filings.
I am one of the July2 (J Barret, 10:25am) filers on the waiting, and I know the anxiety we all have. You can write to your Congressman, but think of how USCIS is going to respond to the intervention. They will tell that they are not yet finished with all receipts.

I had the same issue...
Here is the short version of how it unfolded. I've seen some quick responses from USCIS.
9/15/2010 - USCIS email indicating that cards mailed for both me and spouse
9/16/2010 - Spouse received card
9/21/2010 - Got email (LUD) that my card returned undelivered.
9/22/2010 - Called customer service updated the address
9/23/2010 - Got my card in mail (wrapped in an usps priority envelope) with tracking number
I was pleasantly surprised with the fastness of USCIS.
Thanks,
Now my status changed to 'Initial Review' because post office returned my mail  Within 12 hrs status changed from 'Card Production' (05.03 PM) to 'Initial Review' (06.33 AM).
I had updated my new address 3 yrs before and was confirmed by infopass appointment.

You basically get an I131 which has all your immi information on it. It also includes your photo and validity period. There is also an area for stamping it when you re-enter the country. I hope this helps.

I've sent the letters to the WH and IV. Hoping for the best.
I, however, have some questions for the senior members of the IV team. Especially for the ones who are active in the lobbying efforts in Congress and the White House. How realistic are the chances for Green card visa numbers relief, even for the longer term? It seems like there are immigrants from 2 countries - India and China who are adversely effected by the low visa numbers. If one is an immigrant for any other part of the world, it actually isnt that hard to get a Green Card thru employer sponsorship. That being the case, do you think Washington would consider this an issue that needs expedient resolution or for that matter an issue that needs a resolution at all?
Dont want to sound like a downer in this inspiring thread, but at the same time, any answers to my question will be greatly appreciated.

I do understand that without evidence you can't fight the conventional way or file a law suit. It would be difficult, if not impossible. I am not debating that. I never said it would be easy. Even with evidence (in case of Capital One), one can argue if thats a good enough base for fighting and whether it will do any good if the case is won. Thats not the point.
What would you do if a recruiter or employer told you (verbal or writing) that it is their policy not to hire Indians? (I am just using India as an example).
Regardless of written evidence, I would be inclined to do something about it. I am not saying that I will file a law suit. I would probably not even want to work for such an employer. But I will not be speculating that oh, there must be some loophole that allows employers to have such a policy; because many of them are saying that, it must be legal. I will not assume that they can do this under "Hire and fire" authority. We just seem to have a little difference in opinion about that. We agree on pretty much everything else. Thats all. And frankly, its good to have an opposing perspective on things.
Now, if I hear from experts that my understanding of the discrimination laws is incorrect and that it is legal for an employer to say that they will not hire somebody with EAD, I'll just shut up. Until then, I will encourage people not to be quiet and to call the hotline, file a complaint, call the media, and pursue whatever means we have at our disposal to fight what we consider injustice and fight what we believe is discrimination as per the law.
Now, I am with you:)

It really is amazing how much hot air has been generated on this thread over a well established transit visa requirement.
The reason transit visas are required in the UK is that many passengers with an intention to transit the UK have stayed. The transit visa was introduced as a way of making sure (as much as possible) that the passenger has the intention and the ability to transit the UK and to enter a third country.
The list of nationals that are required to have a visa to transit the UK represents a list of countries where there has been a particular problem with over stayers. It is not race based, but merely an effort to target the problem.
It really does not matter what anyone thinks about the transit visa requirement because it is UK law. Everyone has a choice whether or not to transit the UK. Going back to the original post, to book a ticket without researching visa requirements and then trying to deflect personal responsibility by blaming the visa requirement is ridiculous.
I would say only this. Get yourself admitted into a hospital and get some oxygen pumped into your freaking brain (sorry, if it sounds harsh, but it is the only way to help you to think clearly). Read the post again, please, I beg you. I wrote the post only because the UK embassy overcharged and did not think it is at all necessary to return the excess amount. Regarding your comment about doing the research, let me tell you, there are idiots like me who would rather do something else and leave things to logic and former experience. Ordinary people like me have other things to do in life, like managing their day job, negotiating the daily commute, picking their kids from school, taking them to their extracurricular activities, managing their homework, and other things which only end at 10:00pm. Between all this cacophony, how do you think I should managed a situation when my travel agent call me and gives me 5 minutes to decide if I need to take a flight going through such and such city with all legs confirmed, and that too during the month of Nov-Dec?

I have not seen the language of the bill. Has anyone seen the exact language of the bill?
Should this bill become law (in its present form without any changes ) will the new provisions apply to ANY H1B application (i.e new applications, Transfer due to change of employer , H1B extension application with current employer) or just to NEW H1B applications and not to H1B extensions filed by the currentemployer.
There are hundreds of H1B applicants who do not have EAD but have approved PERM or approved PERM + approved I-140 and will be filing for extensions.
The H1B resttrictions in the TARP law only apply to new H1B filings.
Link (http://www.immigration-law.com/Temporary%20II.html) for full text of the bill.

Keep sending the letters. For all our future action items on this issue - its most important to send large number of letters so officials are aware of its effects and the related concern.
I think 100 or so letters are not going to have that kind of effect; we need several hundreds if not thousands. We are a 30K member organization - we can do better than what we are doing now.
If you havent sent the letters already please do so today, it wont take more than a few minutes.
