    Look at histrocial approval you will know your assumption is incorrect. ROW gets more than half the numbers in any category.

    Yes, it is possible that my assumption is not correct. That is why it is an assumtion:).
    But till I get some "authentic" base to count on I do not have any way other than logical assumption.

    As data what you presented, it was indeed a low rate of approvals for Eb3-I with comparison to EB3-ROW but that was mainly due to the fact that lot many Indians were screwed and stuck in state based labor queue and PERM queue and I-140 queues for years where as EB-ROWS guys did not face that punishment as intensively as we did.

    Should your address showing up on your w2 and pay stub be matching with the address of your parent company that filed your LC for Permanent Residence? My parent company that filed for my GC is in MI and so my Labor was also filed from there and currently I am working in IL and have been filing tax return for the state of IL for the last 3 years. The addres that shows up on my pay stub and w2 is for the state of IL. As my I485 is already filed so would it matter at the time of adudication of I485 about this address issue?

    The flower campaign has been a spectacular success. Lets not dilute it or confuse it with food or pizza campaign. Lets the free flow of flower campaign contunue.

    There is a symbolism of peaceful protest behind flowers, its universaly understood, what is the symbolism behind sending food, it might be misunderstood. Lets not overdo it.

    It is unfortunate that people don't even try to understand the issue and just go about complaining it.
    Most people can't even differentiate between what is law and what is not. What are difficult things to accomplish and what are not.

    It is absolutely imperative that 5882 pass otherwise the situation will continue to exist.
    Here are the my estimated waits for EB3-I
    PD(end of the calendar year) and its corresponding wait in years
    2001 1 year
    2002 3 years
    2003 4 years (Bad economy in 2002 and early 2003)
    2004 7 years (Case surge in 2003 and 2004 due to booming economy)
    2005 8 years (fewer cases in 2005 due to PERM)
    2006 10 years
    2007 12 years
    2008 .....

    FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

    I have similar experience. I moved to sunrocket (which is now teleblend) from vonage. I pay half of what I used to pay vonage for same services/usage.

    currently teleblend offers $50 unlimited india calling + ofcourse US+canada unlimited. However as now vonage has come up with $25 world plan, I am sure teleblend would come up with something similar soon... may be $20 world plan or so. As they always price it below vonage. Let's hope! competition is good for consumer.

    apply for EAD for sure as it will help if your wife wants to work.

    apply for AP if you think you will not have time to get the H1 and H4 visa stamps in your passport when you travel to your home country in that case you will have to entter back on AP

    Nothing will happen. The dates will be retrogresses on Monday. May be we will see 'U' in Visa Bulletin. The AILA will try to pursue DOS and USICS but they will politely say "sorry for the trouble" This will lead to the law suit. Some people will submit their resignation. In the next year you will see those at some higher post somewhere.

    Wow. We are living in the great country built by Immigrants were there is no value of Immigrant. For undocumented immigrants, there are senators to help them. For rich people, they have money so don't have to do anything. For middle class immigrant like you and me IV forum is there to show our frustration.

    I am now seriously thinking of going back to my home country were I would be considered moron who came back from US.


    This is nothing new, things like this happen in almost all parts of the world. Remember Enron, one fine morning thousands of people found that their life savings or retirment savings got wiped out clean with nothing to fall back on.     EB3 Porting could use up to 8K though, and new filing could be 2K
    and EB2 I/C pre-07/2007 still have about 34K at the beginning of oct/2010
    So it is even at most...

    There are lots of uncertain
    1. EB1 is now the biggest uncertainty
    2. EB2 ROW
    3. Porting
    But EB1 and Eb2 ROW, EB2 I/c new fling (ppl who missed 07/2007 w/ PD before 07/2007) have to file in May to get it approved by Sept as processing time is 4 month.
    So After May, from June to August, it is all spill over game for EB2 I/C
    That is why i guess Charles is saying the trend is now, and will start use the numbers in May

    If 44k is the available number for EB2 I & C then the PD will move upto Jun 2008 with out any doubt. Even with the porting of EB3 to EB2 is accounted for.

    I am so emotional now........just got the email, text message and message on the website changed to "Decision"

    Mine, my wife's and my son's cases APPROVED!!!!

    My case was in NSC. No additional fingerprinting, except one in Oct 2007, my son had to do one since he turned 14 this year....

    14 years of wait is over......Praise be to God for his faithfulness and mercies

    I also had my visa interview on 27-DEC-2007 @Mumbai (h1-b/h-4 renewal) and was told that I will receive an email in 2 business days, subsequent to which I will have to go to VSF office for getting my visa stamped.

    Seems like there might be an internal memo or understanding between USCIS and DOS not to approve many Eb2 India 485 even though there dates are current, this is the only explanation I can come up for the lack for eb2 india approvals in October. Even with the limited number of visas every quarter I was hoping there would be lot of approvals because of Visa spillover occuring every quarter instead of once every year, but looking at the USCIS performance in the first week of october it seems like there wont be any quarterly spillover at all.

    Even if quarterly spillover happens, it will happen in Dec - that's what I think - correct me if I am wrong.

    I anticipated monthly EB2-I to be finished in two business days - more or less it appears to be (200 odds is a small number for India). Now I am waiting for prioirty dates - whether they show +ve movement and next month for approvals.

    How will these affect the processing times.
    I guess these cases that qualify are all propbably pre-adjucated. In that case will it increase the processing time for PERM, I-140 and 485 stages.
    How will EAD and AP extensions get affected.

    They have not specified anything like my prior company is fake in any of the communication email.They are asking me come back because they find something wrong about my prior company after four year and i am not able to provide more evidence.During four year i worked in 10 to 15 project for diff client and for each project first they did BG and put me in project.Now they are asking me that provide some more evidence or come back to offshore.
    I know if i come back to india they will give me layoff from company.In this situation how do i fight with my company.

    Yes, "Interviewing" is not written there. And we all know that "Recruiting" or "Hiring" is not equivalent of "interviewing"

    The employer will come up with many excuses to not interview a candidate or hire. If the law doesn't allow you to discriminate when hiring based on national origin or EAD or whatever, rejecting candidates even for an interview doesn't make sense.

    Interview is part of the hiring and recruiting processes. Would you say employers putting a job ad saying we will only interview someone from a particular nationality is allowed?

    However, the more important point is we are fighting to get multi-year EAD in IV among other things. The law doesn't allow discrimination based on EAD for hiring. Let the govt lawyers and employers figure it out if not even interviewing candidates because of EAD comes under the purview of hiring or not and if it is legal or not.
