    I was asked for the AP in India and Germany. The custom officer in India was aware of the AP and immediately completed the process and let me go. In Germany the 1st person ( probability a new hire) did not understand the AP so he asked another custom officer to look at the AP document. The other office looked at the AP and then explained the document to the 1st officer and let me go.

    BTW, the trip last month was the 3rd time I traveled to India on AP.

    Starting July 16th, 2007, labor certification has a 60 day validity period. Meaning, a I-140 petition needs to be filed within 60 days from labor approval date....If immigrant visa numbers are unavailable (dates retrogressed), you wont be able to file your I-140/I-485 concurrently but you can file your I-140 petition irrespective of your priority date as long as you have a labor approved. You dont have to apply for your labor again and again....Its just that, once you get your I-140 approved, you will have to wait for dates to become current to file I-485...

    This states that, unlike earlier, petitions filed without initial evidence are more likely to be rejected than to be RFE-ed. (See towards end of first page).

    guys cool down it took them till end of May about 2 months to issue all receipt notices for H1 filed on Apr 2 this year. With the whole yes-no-yes situation this month they are definitely backlogged. Lets just wait till we actually get the receipts .

    there is no point in calling names.
    but remember, this is over 5 times (Conservative estimates) more than the H1B numbers.. 65K......
    There is no comparison.

    I understand that is not a reliable source of tracking approval pattern, however, this is the only tracker we have available and this gives us fairly good idea about USCIS processing.

    Based on , there are about 1200 Approvals for EB-2 (Including ROW, India and China) since Oct01 2007.

    However, there are only 450 approvals for EB-3 (Including ROW, India and China) sine Oct01'2007.

    So howcome they ran out of EB3 numbers when there are very few approvals for this year. I was hoping they will run out of EB2 numbers instead.

    Any insight on this?

    There are disadvantage of filing AC-21 eg: RFE or Interview calls etc

    What are the disadvantages of NOT filing AC-21 Memo to USCIS after job change?

    Its all gray, but after reading posts on forums the disadvantage is the same: RFEs.

    If your employer withdraws your I-140 180 days past your 485 filing, USCIS will potentially issue an RFE again for employment verification letter. If you had filed a new EVL at the time of doign AC-21, USCIS knows that the I-140 revocation does not mean the end of the road, you have actually ported over to someone and he intends to hire you. Note that even 180 days past your 485 filing, you still need SOME employer to sponsor a same/similar job. (unless you are exceedingly brave and are going to self-port)

    Right now for all bills that Zoe proposed there are max 19 co sponser for this last bill. DID you check for STRIVE ACT 2007 which had 78 co-sponsers still could not make it to floor.

    We need to call these lawmakers and educated them on these bills.

    Chances are less but our investment is not that big. Few minutes in a day to call or write.

    If true this would REALLY benefit a lot of spouses especially someone like our core member Shilpa.

    I am just surprised that none of the Big law firms have reported it. I guess now the h4's will have to wait till Oct 2007 to get their H1Bs

    Is this a new "law"? I thought USCIS cannot pass "laws" on its own. Or this simply an intepretation of an existing legal procedure ---- which I understand USCIS is allowed to do on its own?

    You are right, the PMP doesn't really fit too well with more contemporary software development methdologies of today. But the book still adds some value in that it still talks about the basic fundamentals of planning, executing and monitoring - which are activities practiced in all industries.

    I did get some additional value by reading up on agile project mgmt. Its more software dev specific.

    Asking an architect for an opinion on proj mgmt is a waste of time. There usually is a sharp divide between their perspectives (i've been on both sides of this debate). Technical architects usually feel mgmt is a bunch of fluff, which many times it is, but a lot of it is still "essential" fluff :)

    I may have to respectfully disagree with this.. Mine was approved on June 13th 2006 and my PD is current.. I have seen many EB2 with a later PD and 140 approval being approved.

    There is only ONE trend... that is NO TREND :p

    -What is the minimum period that one need to work with the employer who has sponsered the GC after receiving the GC?
    -Can the leave of absence be counted in this period?
    -If you leave immediately (with a month) after GC, can the employer fill for revoking or mistrust for I485?

    Mark Kirkoreiean's (or whatever his name is) thesis is that not everyone who gets a green card through EB is a genius, and that is not good for America.

    Along same lines, I would like to ask, Mark or whoever in anti-immigration camp,
    there are only 1M (may be little less) skilled workers looking for immigration and you have problem with that because all of them are not THE BRIGHTEST one, okay... well first understand, for THE BRIGHTEST we have EB1 which is working great. Now in America there is a lot of work which needs experienced and highly skilled worker and we have EB2 for that, apart from that we still have a lot of work which requires hitech skilled worker and for that we have Eb3. So by the definition system has already identified the need and have representation for those.

    And secondly you have problem with those who came legally and are highly skilled and have followed all the rules since day 1, counts less that 1 million, you are not willing to give them GC on other hand there are 12M (actually 20 M) who can't even write their names in English and everybody is ready to give them GC even the president of US is ready.

    Doesn't that give signal that US is pro illegal and anti-legal immigration.... think about it

    They asked the biggest takers of H-1B visas. They just so happened to be Indian companies, funny enough.

    I don't see why you would think of the bill as insane. It weeds out the abuse clogging up an otherwise great visa program.

    Hello All,
    I suggested this in my last two posts and I am suggesting this again. Emails , faxes to Rep will not create visibility of the problem. What we need to do is, do something big, like a DC rally again. One of the benefits behind doing this will be, everyone in this country i has their eyes on DC for presidential elections. Hence more visibility for us.


    Secondly the topic of these three bills is hot, if we don't do anything now, it will turn cold, and then will be forgotten.


    What we really need is a huge volume of high skilled workers in DC, not just a handful. Please let us all get together in DC again and push for these bills. We will get a lot of visibility. How about sending flowers to congress members?
